This volume for the first time brings the scholarly discipline of comparative religious ethics into constructive collaboration with the community of interreligious dialogue. Its design is premised on two important insights. First, interreligious dialogue offers to comparative religious ethics a new, more persuasive rationale, agenda of issues, and practical orientation. Second, comparative religious ethics offers to interreligious dialogue an arsenal of critical tools and methods which will enhance the sophistication of its practical work. In this way, both theory (a dominant (...) concern and strength of comparative religious ethics) and praxis (a dominant concern and strength of interreligious moral dialogue) are joined together in mutual effort, each contributing to the benefit of the other.The volume’s contributors share this vision of collaboration, drawing explicitly from both communities of discourse in a manner that crosses disciplinary and professional boundaries to deal creatively and constructively with important methodological and global moral issue. Although theory and practice cannot easily be separated in such a collaborative project, for the purpose of clarity, the volume is divided into two main parts. The first specifically engages questions of method, theory, and the social role of the public intellectual; the second, on substantive moral themes and issues, many of which were raised at the 1993 Parliament. Taken together, the volume’s essays articulate and illustrate new ways of approaching contemporary moral concerns cross-culturally yet with a rigor appropriate to our complex and pluralistic world. An illustrative comparison of human rights in 1948 and the contemporary period, attempting to gauge the impact of globalization on changes in the content of human rights (e.g., collective rights, women's rights, right to a healthy environment), major abusers and guarantors of human rights (e.g., state actors, transnational corporations, social movements), and alternative justifications of human rights (e.g., pragmatic agreement, moral intuitionism, overlapping consensus, cross-cultural dialogue).

This essay is an exploratory inquiry into possible Christian ethical residues in the field of comparative religious ethics (CRE), focusing particularly on the themes of tradition and canon, trajectories of ethical reflection, emancipatory criticism, common morality, and the notion of discipline. It is suggested that even if such traces exist, they may not be detrimental to the field as currently practiced.

After sketching the three basic types or generations of human rights recognized by the international community, the author explicates their principal conceptual-historical features in four theses concerning socially guaranteed priority interests; hermeneutical interaction; levels of intercultural and intracultural justification; theory-neutrality; he then explores yet further implications of those features. The article concludes by sketching alternative conceptions of the levels of human rights justification, relating these to recent philosophical positions on the prospects for a common morality.

This essay is a brief attempt to summarize and evaluate the contributions that "Democracy and Tradition" makes to the field of comparative ethics. It is argued that the potential impact of these contributions would be strengthened by engagement with the common morality already imbedded in international human rights norms.

This paper examines the contributions that the international human rights community can make to the definition and framing of a practically effective global ethic, especially in light of ongoing concerns about social and economic justice, environmental issues, and systematic abuses of vulnerable populations. The principal argument is that the human rights movement in all of its dimensions (moral, legal, political) provides the pivotal foundation for a practicable global ethic now and for the foreseeable future. Evidence for the truth of this (...) claim is discerned in the movement's contemporary efforts to intersect explicitly with other areas of international law and politics. Chinese attitudes toward war are rich and nuanced, ranging across amoral realism, defensive just war, humanitarian intervention, and mournful skepticism. Covering the five major intellectual traditions in the "golden age" of Chinese civilization: Confucian, Daoist, Mohist, Legalist, and Military Strategy schools, the book's chapters immerse readers in the proper historical contexts, examine the moral concerns in the classical texts on their own (...) terms, reframe those concerns in contemporary ethical idioms, and forge a critical dialogue between the past and the present. The volume develops fresh moral interpretations of classical texts such as The Art of War, Mencius, Xunzi, Mozi, and the Daodejing and discusses famous philosophers such as Han Fei and Wang Yang-ming, representing antithetical schools of thought about warfare. Attention is also given to the military ethics of the People's Liberation Army, examining its thinking against the backdrop of its own civilizational context. Abstract Building on the authors' previous work regarding the classical Confucian position on the legitimate use of military force as represented by Mencius and Xunzi, this paper probes their understanding of punitive expeditions undertaken against tyrants in particular ? aims, justification, preconditions, and limits. It compares this understanding with contemporary Western models of humanitarian intervention, and argues that the Confucian punitive expedition aligns most closely with the emerging ?responsibility to protect? model in Western discussions, although it also differs from the (...) latter in certain respects. For example, the Confucian expedition explicitly forwards as legitimate aims regime change and the punishment of tyrants, in addition to rescue of an abused population and assistance in rebuilding a decent society. The Confucian understanding also appears to set a lower threshold standard (well short of genocide, ethnic cleansing, or large-scale massacre) for what counts as severe tyranny warranting intervention, and it explicitly speaks of an obligation (beyond mere permissibility) to intervene when that threshold is exceeded. In its concluding section, the paper discusses some possible contemporary implications of the classical Confucian understanding of a punitive expedition against tyrants. (shrink)

By posing a heuristically provocative question, this essay compares and explores in some detail the testimonies of three infamous perpetrators from the Nazi period—Albert Speer, Rudolph Hoess, and Adolf Eichmann—for what they reveal about their motives, ideological thinking, and strategies of denial and self-deception, as well as influences from their social, political, and cultural context. The conclusion drawn is that many of the external and internal factors at work in them are recognizable to us as features of our own moral (...) experience and, further, that this recognition is particularly important for motivating self-scrutiny in our own lives for any hints of impending complicity with moral evil. FOR THE PAST TWO YEARS I HAVE BEEN TRYING TO UNDERSTAND THE causes and mechanisms involved in human rights atrocities, as well as strategies for preventing or interdicting their occurrence. Although I have focused my attention on social scientific and psychological investigations in an effort to develop an integrated schema or framework that could be applied to particular cases, I launched a faculty seminar at Florida State University and taught correlated courses on crimes against humanity that specifically used humanistic materials (...) in examining such criminal activity. The underlying rationale for this effort stemmed from the charge to the FSU human rights center to develop an interdisciplinary curriculum emphasizing the international, comparative, and interdisciplinary aspects of human rights education and drawing on faculty resources throughout the university's schools and departments. In this essay I report on the theme that emerged in the FSU initiative that human rights education could be especially enhanced by engagement with humanistic materials ranging across history, literature, philosophy, and the arts. These materials can raise profound questions, appeal to the imagination and moral sensibilities, and engender critical and creative thinking. (shrink)

A critical examination of Richard Miller's position in his recent "Children, Ethics, and Modern Medicine" on how to handle pediatric interventions in cases of cross-cultural conflict between parents and doctors with respect to treating young children. Particular emphasis is placed on Miller's interpretation of and arguments about a Hmong case extensively researched by Anne Fadiman in her "The Spirit Catches You and You Fall Down". Twiss London: Routledge, 2015. 320pp. $160.00As Ping-Cheung Lo notes, Western stereotypes of Chinese culture and particularly of Confucian ethics have led many to describe ancient China as a place of peace and cooperation—a picture (...) that is contrary to historical evidence (249). This new volume, edited by Lo and Sumner Twiss, offers an important corrective to that image. The contributing authors describe the moral attitudes toward war and peace taken by Chinese thinkers in several schools during the Warring States Period of 475–221 BCE (along with one later figure, the sixteenth-century neo-Confucian Wang Yangming). In particular, they focus on five traditions: military strategy, Confucianism, Daoism, Mohism, and legalism. The authors collectively demonstrate that ancient Chinese thought was marked by an intense interest in both peace and war, and that these topics were approached from moral as well as strategic and prudential perspectives. Moreover, in their historical contextualization of these materials, the authors emphasize the significance of the reality of war in shaping the arguments discussed. This attention to interpretation and real-life applications of these arguments, in both the ancient world and the contemporary activities of the People’s Liberation Army, is a particular strength of the book.This volume will be of special interest to comparative religious ethicists as well as to those interested in just war reasoning. As the inclusion of the phrase “just war” in the book’s title suggests, the identification of parallels to Western just war thinking in ancient Chinese thought is a major emphasis. Lo argues that although the Seven Military Classics are often read simply as strategy manuals, their discussions of strategy are complemented by concepts similar to the just war criteria of just cause, last resort, and discrimination. Twiss and Jonathan Chan suggest that the Confucian “true king” who is to oversee war [End Page 226] virtuously and with the goal of maintaining an ordered, humane society represents a requirement similar to the just war criterion of right authority; importantly, however, “right” in the Confucian tradition comes from the ruler’s virtue rather than his sovereignty. Hui-chieh Loy’s study of the Mohist tradition identifies concepts similar to six different jus ad bellum criteria while also revealing a lack of jus in bello criteria. Finally, Lo argues for the similarities between ancient legalism and contemporary Western realism as an alternative to just war thinking.Future scholarly development in this area should include a more robust articulation of the purpose of taking this comparative approach. Some reasons are implied in the book. For instance, Twiss and Chan argue for the overlap of Confucian punitive expeditions with the contemporary model of responsibility to protect, suggesting the possibility of international consensus on that norm. On the other hand, comparative work always runs the risk of distorting or overlooking material as a result of the desire to identify similarities or differences to a particular framework. Aaron Stalnaker, for example, points out that while Confucian thinker Xunzi may have embraced some concepts similar to those of jus ad bellum and jus in bello, he did not structure his own writing in those terms (135). Similarly, Ellen Zhang argues that the Daodejing differs from just war texts in that it approaches the question of war from the perspective of a particular conception of peace as an absence of coercion; the text thus takes the avoidance of war as its moral ideal. She also suggests that Confucian punitive expeditions may be better understood as domestic criminal discipline than as acts of war or humanitarian intervention (220). Sumner B. (Barney) Twiss, who died in 2023, was for ten years a General Editor of the Journal of Religious Ethics (JRE). He was a frequent contributor of articles, a member of the JRE Editorial Board, and a member of the journal's Board of Trustees. In this article, colleagues and students reflect on some of his many contributions, not only to the JRE but to the broader discursive fields of comparative religious ethics and human rights.

The spectacular development of medical knowledge over the last two centuries has brought intrusive advances in the capabilities of medical technology. These advances have been remarkable over the last century, but especially over the last few decades, culminating in such high technology interventions as heart transplants and renal dialysis. These increases in medical powers have attracted societal interest in acquiring more such knowledge. They have also spawned concerns regarding the use of human subjects in research and regarding the byproducts of (...) basic research as in the recent recombinant DNA debate. As a consequence of the development of new biomedical knowledge, physicians and biomedical scientists have been placed in positions of new power and responsibility. The emergence of this group of powerful and knowledgeable experts has occasioned debates regarding the accountability of physicians and biomedical scientists. But beyond that, the very investment of resources in the acquisition of new knowledge has been questioned. Societies must decide whether finite resources would not be better invested at this juncture, or in general, in the alleviation of the problems of hunger or in raising general health standards through interventions which are less dependent on the intensive use of high technology. To put issues in this fashion touches on philosophical notions concerning the claims of distributive justice and the ownership of biomedical knowledge. (shrink)

The breadth of Little's research interests is reflected in the diversity of essays represented in the volume. Some of the seventeen chapters reflect directly on issues within Little's corpus while others discuss the influence Little had on various fields of inquiry or draw on his ideas for new areas of research.John Witte and Gene Outka provide essays of the first sort: Witte examines Little's work on the religious origins of human rights, while Outka raises questions about how Little's historical work on Reformed Protestantism relates to his work in human rights. Outka raises broader questions about methodology in religious ethics, questions also explored in a chapter by John Kelsay. These include foundationalism, the role of normativity in the study of religion, and the role of expressly theological concepts in religious ethics. The questions are intertwined but played out in different ways in Little's scholarly career; the first [End Page 224] two issues arose in response to the 1978 volume, Comparative Religious Ethics: A New Method, which was foundationalist in orientation. It sought to find the "basic" norm that was the ground of all other moral ideas in a religious system, whether Christianity, Buddhism, or the religion of the Navajo. Jeffrey Stout's critique of the book's foundationalist assumptions struck a serious blow to the project; in response, Little conceded so many of Stout's points that Stout questioned whether the methodology of the volume was meant to be taken seriously. As Kelsey notes in his chapter, some wondered whether the rigid methodology of Comparative Religious Ethics was created primarily to give religious ethicists a respectable job to do in an academic environment in which the study of religion was otherwise suspect. It sought to create a neo-Weberian study of religious ethical systems in which the scholar bracketed out her own ethical assumptions. Through this "value-free" descriptive science, the comparative ethicist hoped to gain admission to the secular academy. Foundationalism was meant to provide the kind of objectivity that gave the religious ethicist something objective to study. Giving up foundationalism would mean giving up the hope of comparative religious ethics as a science.This brings us to the role of distinctly theological claims in Little's work. When putting on the normative hat of the ethicist, Little preferred to bracket out theological assumptions, precisely in order to maintain conversation with his nonreligious interlocutors. The benefits of such a method are evident in this volume. Little managed to engage in moral and political conversation with scholars across a variety of religious, political, and national locations. As is clear in Little's afterword to this volume, he believes that bracketing out his first-order theological assumptions made this dialogue possible. But how can we be sure that this is the case? Perhaps other intellectual and moral virtues allowed this dialogue to flourish, and perhaps Little's virtues would have made such a dialogue possible, even had he been more open about his theological assumptions all along the way. It's hard to know for sure. But in light of the difficulties involved in bracketing out first-order theological assumptions, perhaps the better option is to make one's assumptions explicit while remaining willing to change one's mind when given compelling reasons to do so. Margaret Mohrmann, Paul Lauritzen, and Sumner Twiss raise questions about my account of basic interests, liberal theory, and the challenges of multiculturalism as developed in "Children, Ethics, and Modern Medicine." Their questions point to foundational issues regarding the justification and limitation of parental authority to make decisions on behalf of children in medical and other contexts. One of the central questions in that regard is whether adults' decisions deserve to be respected, especially when they seem contrary to a (...) child's or adolescent's basic interests. Questions about respect, in turn, focus attention on others' decisions about what seems good for families and children, decisions that may be paternalistic or utilitarian. Such decisions are further complicated by a child's or adolescent's budding autonomy and need for respect and recognition. Pediatric bioethics grounded in an account of a child's basic interests produces a theory of negative and positive rights for assessing adults' actions in relation to children, especially (but not only) when adults demand respect in their expressions of care. © 2015 Elsevier Inc.Postnatal organogenesis occurs in an immune competent environment and is tightly controlled by interplay between positive and negative regulators. Innate immune cells have beneficial roles in postnatal tissue remodeling, but roles for the adaptive immune system are currently unexplored. Here we show that adaptive immune responses participate in the normal postnatal development of a non-lymphoid epithelial tissue. Since the mammary gland is the only organ developing predominantly after birth, we utilized it as a powerful system to study (...) adaptive immune regulation of organogenesis. We found that antigen-mediated interactions between mammary antigen-presenting cells and interferon-γ -producing CD4+ T helper 1 cells participate in MG postnatal organogenesis as negative regulators, locally orchestrating epithelial rearrangement. IFNγ then affects luminal lineage differentiation. This function of adaptive immune responses, regulating normal development, changes the paradigm for studying players of postnatal organogenesis and provides insights into immune surveillance and cancer transformation. We argue in favour of the general proposition that the nature of reasoning is best understood within a context of its origins and development. A major dimension of what develops in the years from childhood to adulthood, we propose, is increasing meta-level monitoring and management of cognition. Two domains are examined in presenting support for these claims—multivariable causal reasoning and argumentive reasoning.

High stress despite low tidal volumes may worsen lung injury and increase risk of death. No widely available parameter exists to assess global lung stress. We aimed to determine whether the volume delivered during a recruitment maneuver is inversely associated with lung stress and mortality in acute respiratory distress syndrome. Design: Substudy of an acute respiratory distress (...) syndrome clinical trial on esophageal pressure-guided positive end-expiratory pressure titration. Setting: U.S. academic medical center. Patients: Forty-two patients with acute respiratory distress syndrome in whom airflow, airway pressure, and esophageal pressure were recorded during the recruitment maneuver. Interventions: A single recruitment maneuver was performed before initiating protocol-directed ventilator management. Recruitment maneuvers consisted of a 30-second breath hold at 40 cm H2O airway pressure under heavy sedation or paralysis. VRM was calculated by integrating the flow-time waveform during the maneuver. End-inspiratory stress was defined as the transpulmonary pressure during end-inspiratory pause of a tidal breath and tidal stress as the transpulmonary pressure difference between end-inspiratory and end-expiratory pauses. Measurements and Main Results: VRM ranged between 7.4 and 34.7 mL/kg predicted body weight. Lower VRM predicted high end-inspiratory and tidal lung stress. After adjusting for Pao2/Fio2 and either driving pressure, tidal volume, or plateau pressure and positive end-expiratory pressure, VRM remained independently associated with both end-inspiratory and tidal stress. In unadjusted analysis, low VRM predicted increased risk of death. VRM remained significantly associated with mortality after adjusting for study arm. Conclusions: Low VRM independently predicts high lung stress and may predict risk of death in patients with acute respiratory distress syndrome. (shrink)
